These Terms of Service ("Terms") govern your access to and use of Figureworthy, available at figureworthy.com (the "Service"). In these Terms, "we", "us", and "our" refer to the team that operates the Service. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of the Service
Figureworthy lets you upload a photo, choose a name and a visual style, and generates a digital image of you as a collectible action figure in its packaging, using Google's Gemini image model. You receive a downloadable image, not a physical toy. Each image is a one-time purchase; there is no subscription.
2. Purchases and Payment
Each image costs a one-time fee of USD 2.99, charged before the image is generated. Payments are processed by a third-party payment provider; we never see or store your full card details. The payment provider's own terms also apply to your payment.
3. Your Content
You must only upload photos you own or have permission to use, and you must not upload photos of anyone else without their consent. You retain ownership of the photo you upload and of the image generated for you. You grant us a limited license to process your photo and the name you provide solely to generate that image.
4. Acceptable Use
You agree not to use the Service to upload photos of minors in an inappropriate context, upload content you do not have rights to, generate illegal, harmful, or infringing content, or abuse, overload, or interfere with the Service.
5. Disclaimer of Warranties
The Service is provided "as is" and "as available." Generated images are produced by artificial intelligence and may not match your expectations. We do not warrant that the Service will be uninterrupted or error-free, or that outputs will meet your requirements. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
6. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the claim, or USD 2.99, whichever is greater.
7. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes take effect means you accept the updated Terms.
8. Governing Law
These Terms are governed by applicable law. Nothing in these Terms limits the mandatory consumer-protection rights you have in your country of residence.
